Landlord Tenant Rights

Landlord Tenants rights are extremely important in ensuring a fair and just relationship. Landlords and tenants have equal rights. Some of them are listed below:

1. Rent: Landlord can determine rent. He has the right to collect rent on time. He can change the rent after providing ample notice. The tenant can refuse to pay rent if the landlord is not fulfilling his responsibilities or if the rent is changed without notice.
2. Security Deposit: the landlord can ask for a security deposit at the time of signing the rental agreement. The tenant has to right to be refunded the deposit upon moving out. If there is any damage to the apartment, the landlord can keep some or all of the deposit for the repairs. The tenant must be given a receipt and an account of the deposit.
3. Eviction and Lawsuits: Landlord can evict the tenant for criminal activity, disruption of peace or destruction of property. He must file a lawsuit and get eviction papers before he can forcibly remove the tenant. If the tenant feels like he is being treated unfairly, harassed or unjustly prosecuted, he can file a lawsuit against the landlord.
4. Demolition, repairs and improvement: If the landlord wants to repair or improve some or all of the property, he can ask the tenant to move out for the duration of the work. He can do so after giving p[roper notice. If the landlord wants to stop renting the property or demolish it totally he can also do that after giving ample notice.
