I have some idea of what section 8 housing is, but what is section 42?

"What is Section 42 housing? Section 42 refers to that section of the IRS tax code, which provides tax credits to investors who build affordable housing. Investors receive a reduction in their tax liability in return for providing affordable housing to persons with fixed or lower incomes. In return for this tax credit, investors provide important equity to insure that quality housing can be constructed with rents that remain affordable. This program has proven to be very successful nationwide, and is quoted to be driving 70% of the new construction of multi-family housing nationwide. "

Assuming they have vacated, you have to sue them in small claims court. If they're still in the unit you should give them a three day notice to pay and then proceed with eviction if they don't pay.

As Ed indicates, the government will not be liable for the tenant's portion of the rent and will not normally compensate for damages. You have to seek collection in the same way as for any other tenant. One of numerous disadvantages of Section 8 is that the landlord is less likely to collect because of the financial condition of most Section 8 tenants.

Where to I get an application to provide section 8 housing? Also is there any programs for properties that are half way houses? thanks

Call your local HUD office and they can set up an inspection of your property. However, personally ... there are easier ways to shoot yourself in the foot.

There should be more people like Melodee who want to provide Section 8 housing and you shouldn't try to discourage her. The problem with landlords is that they only report when things go wrong with Section 8 tenants so people have this idea in their minds that all/most section 8 tenants are slobs/thieves/drug addicts, when in reality most Section 8 tenants are struggling single moms or disabled people who can't afford to pay the fair market rent in most cities. Landlords never talk about all the good, clean "normal" Section 8 tenants that they have. It's human nature to focus on the negative but the problem is that it makes it hard for all people on Section 8 because of the stigma.

Unfortunately, many landlords have had bad experiences with Section 8 tenants and/or with administrators of the program. Many of those landlords will agree with MLR's advice.

If I in any way indicated that the problem with Section 8 is with the tenants, I apologize. The problem is with the government and how they implement the program. As a LL That has been in the business for 20+ years.... I have put my life into this business. We have been able to make a nice living from our investment of time and money. It has been very hard at times. I will NEVER give up my control of my life's work to any government entity. That includes HUD and Section 8. I have many low incomes tenants with whom I am happy to work to find help for them when they come into bad times. I will - however - never ever as long as I live .... get into a contract with the government where all of the contingencies are based on profit for the tenant and the government and I am the one holding theshort end of the stick. If the government was ever sincere in helping in working with LL's for good housing for tenants ... I would be the first one in line to work with the government - unforunately - the reason most LL's will not accept Section 8 ... is the government paperwork. Its a yolk around the neck of anyone that gets involved. We are obviously successful in life in some ways to have gotten to the point of owning property... why would we let the government choke us with their insanity???? If you are a low income person trhat is working and is a good quality person - there is a LL will work with you. I know that I would ... because I have in the past. But in the words of Scarlet O'Hara ..... "As GOD is my witness" .... I will never accept section 8.

Ivonne, Contact your local housing authority for assistance. You can find additional info. by looking in the phone book government white pages section under housing.
