| Hello all,
My tenant has been in the home since January. I screened her and she has a good credit rating. She has been prompt with her rent since she moved in. She asked for permission for her sister and her 17 year old niece to stay with her whilst they were house hunting. I gave them written permission to stay for 40 days. They signed forms which stated they understood they were long term guests and had no tenant's rights and had paid no money for the right to be in the home. They gave me photocopies of their driving licences. Now the sister cannot find another property because of bad credit as a result of her recent divorce. My tenant wants her & the niece to stay permanently. My feeling is to go ahead and get a credit check run on the sister anyway and if it is bad have her complete a form saying she has no tenants rights and is staying as a guest of her sister. That way if the tenant wants to end the lease I am not beholden to the sister. If the credit check is OK I could have them both sign a roommates agreement to give them equal standing. What do you all think? Any tips, advice or experience would help. Want to make sure my tenant keeps her rights and we are all OK legally. What do landlords do when they have adults stay with their tenants - as in teh case of elderly mothers etc? Appreciate your help in advance. |

| If that happened to me, I would consider raising the rent a little for the additional wear and tear on the apt. - so lets say you charge 1,000 per month, I'd consider raising it 10-15%. However, I would insist that anyone over 18 complete an application and pass by criteria for renting. I would not allow them there as LT guests. |

| Ed is right. For one thing, the more people who sign the lease the more sources for collection, as your lease should make them jointly and severally liable. For another thing, a guest who refuses to leave would probably have to be evicted anyway, as police will not usually remove them if they claim to be a tenant whether or not that is true. Although eviction of a trespasser is usually a little quicker than for a tenant, the difference is in practice not significant and I think that the advantages of more names on the lease outweighs the advantages, if any, of considering them tenants. |

| Ok - thanks for the advice - I'll have her complete the application and put her through the tenant check, then I'll know just how bad the situation is. I'll make the decision on the results of the tenant check as to whether she can stay or not. Thanks everyone for confirming what I knew I should do anyway. Have a great week. |
