need form for broward county eviction

I need a motion for default judgement for eviction. My local court will not accept the form provided by your service. May I be helped? I am out $39 and the forms provided are not working. I thank you in advance for your kind efforts on my behalf. With regards. Sweedledick@comcast.net

The local courts in our area provide the correct forms. Have you already been to a court hearing or are you just starting the notice period? Perhaps your understanding of the procedure is not complete. Usually when we go to court and receive a judgment, we provide the judgment form however, I have seen LL that haven't completed their own form and the court just prepares a computer generated one. You do know that you have to first provide a notice to quit, then let the time pass, then file for a court hearing and then comes the judgment. Default judgment is when they don't show up for court. Consent judgment is when they agree to the terms in advance. At least in our courts.

I am writing in order to express my disappointment in the customer service at the Broward Court Clerk in the City of Hollywood. I went to the Broward Court Clerk in the City of Hollywood last week for a “Default Follow up Procedure” after 5 working days. They gave me a list of forms that I need and purchased two that they sell. I was told the other two, “Motion for Default Judgment for Eviction” and “Default Judgment for Eviction,” had to be purchased at an office supply store or secured from an attorney. I went to an Office Depot, Office Max and Staples; I called three different office supply stores and none carry the forms. I also looked on-line at Browardclerk.org and at the library and I still was unable to find the two forms. Today I went and explained my situation to the lady that was at the window and she insisted that an office supply store would have the forms. Very rudely, she told me to go home an open up the phone book and start calling different office supply stores. I asked her if she was forcing me to hire a lawyer. She proceeded to raise her voice at me. I calmly explained to her that there was no need for her to raise her voice at me and I asked to speak to a Manager. To my surprise, the manager was worse than the employee. She very sarcastically told me that she had opened the phone book and that the first office supply store that she called had the forms. She gave me the phone number and address (Office Depot 4901 Sheridan) and said that she was not supposed to give me that information. I advised her that I went to the Office Depot in Hallandale, as well as the one in Miami and they did not have the forms. Her response was that the one in Pembroke Pines had the forms. I mistakenly took her word for it and went to that Office Depot. They did not have the forms I needed, they had the same forms that I had already seen in all the other stores I had been to before. I spoke to the manager of the store and he said that they do not have those forms and that the Court of Hollywood is always sending people over to the store for the forms. I am a US citizen and I pay my taxes and I should not be treated in this manner. I work and had to take the day off in order to resolve this problem. It is my belief that these forms should be available to everybody without having to hire a Lawyer. The Clerk of Courts is available for the people and should be accessible to the people. And I need to know where to get these forms, because I still have been unable to finalize this situation.

I'd be very surprised if anyone in the Broward Court Clerk in the City of Hollywood monitors this forum, so you almost certainly wasted your time posting your complaint here. I suggest that you file a written complaint with one or more government agencies or persons who might care. This might include County Supervisors, City Council Members, and/or the Presiding Judge of the particular court.

I too have had the same experience with the rude staff at the Hollywood courthouse trying to evict a tenant.It is ridiculous that they do not supply the necessary legal forms. I am certain that they are trying to force people to use an attorney. These forms should be a matter of public record. I agree that these forms are impossible to find in an office supply. The fact that they are not readily accessible to the average citizen is in my view an obstruction of justice. It is disgraceful that these hurdles are placed on taxpaying, law abiding landlords who are the victims in the process of residential evictions. We should collectively file a complaint to try to change the process. Ron S.
