| Tenants Ignore Late Fee Charges |

| I have one renter who paid her rent late in the past, once only. I sent her a notice of amount of late fee owed however it seem she has just ignore my letter. I keep the notices in her files with the intent to deduct late fee from deposit once she moves out.
I have another tenant who consistently pays her rent around the 3d week of the month I send her late notices and she also ignores the late charges. She stated that this is when she can pay her rent because this is when she gets paid by her job. She pays the rent but not the late fee. With this tenant, I have already told her I would not renew her lease, which ends at the end of September.
What would you do if faced with this situation?

| I wouldn't make any issue about the one tenant that paid late once. You are lucky that its not a recurring problem.
With the other tenant, you have a different situation. On the positive side is that she is paying her rent. As far as getting rid of her when her lease expires I would look at the cost. 1) How much will it cost you to get the rental "rent ready", how much rent will you lose while getting the rental ready to rent and having a new person move in. Besides the due date issue, are there any other problems or are they a good tenant? Maybe you go on a month to month after the lease expires. |

| I have atenenat that pays on diff times on the month. the lease says the rent is due the 1st of every month. I asked her for it several times and she continues it to me late. i asked her fot it by the th or a late fee will be charge she said no that she has a grace period of the 15 and due to that i am not able to pay the mortgage on time. what am i 2 do |

| What does your lease say about grace periods? Enforce the lease. If she doesn't pay on time charge her the late fee. If she doesn't pay then serve her with a 3 day notice to pay and that she is in violation of her lease. Do all this in writing and follow through. |

| here is what i did all most all my tenants pay there rent on time but i have a few who don't because of they might lose there job and get a differnt one so i have them come down to the office and ask is this your new pay day so i work with this person i would take the rent later in the month better then none at all just talk to them and work some thing out much better in the long run |

| You need documents to prove your case. This would likely include copies of letters you sent to the tenant saying they had breached the lease, a 3 day notice, or equivalent, etc. I don't think you need copies of checks from the tenants. If they claim you received them all, then they will need to provide copies of the canceled checks. |
