State Lead Paint Law

Md. Ann. Code 83B §§ 2-307 and 2-130 to 2-1311; Establishes lead hazard reduction grant and load programs for owners of residential property to fund lead hazard reduction activities with the emphasis on replacement of windows containing lead-based paint on friction surfaces and concentrating on residential properties constructed prior to 1950; with children who have been diagnosed with elevated blood-lead; families of limited income; or to test innovative methods of lead hazard reduction.

Md. Env. Code §§ 6-301 to 6-303; Prohibits the use of lead-based paint on any interior or exterior surface commonly within the reach of children. Requires the training and licensure of lead abatement professionals.

Md. Env. Code §§ 6-801 to 6-852; Requires owners to register their properties containing lead hazards and abate. Provided immunity from liability under certain circumstances.

Md. Real Property Code § 8-211.1; Allows lessee to ask the District Court to hold rent in escrow without reprisal where owner has failed to abate a lead hazard within 20 days of as violation.
