PARTIAL PAYMENT:

Remind Tenant that Balance Must Be Paid

This letter is for a tenant who has given you a check for partial rent payment. It assumes that the tenant has paid only $400 on their August rent. In the letter, remind the tenant that the lease doesn't allow partial payments to cover the full amount due and that you'll be seeking recovery of the balance. State that your acceptance of the partial payment doesn't constitute accord and satisfaction. "Accord and satisfaction is an agreement to release the other party from the full amount of what is owed by accepting something less."

Dear Tenant: 

This will acknowledge your payment in the amount of $400 on your rent account for the month of August. This payment is only a partial payment of the total amount of rent due.

As stated in paragraph ____ of your lease, please be advised that acceptance of your partial payment does not constitute an accord and satisfaction. Nor does it forfeit our right to collect the balance or to seek possession of our property as a result of your failure to pay rent as required in the lease.
