STORAGE SPACE RENTAL AGREEMENT

 

This agreement is made and entered into by and between __________________________________, hereinafter referred to as "Tenant", and _______________________________________________,
hereinafter referred to as "Owner".

Tenant hereby rents from Owner an area described as ___________________________________, lying and being situated in the County of ___________________, State of _______________, month to month, beginning on the ______________ day of _____________________, 199_ paying therefor to Owner at the address heretofore stated, the sum of $________________________, as the first month’s rent (which has been prorated to the first of next month) and the sum of $_________, as a cleanup/damage deposit. If collected, advance rent in the sum of $____________________, is receipted hereby for the next _________ months. Tenant shall pay, in addition to rent, a $10.00 administrative late charge on all rental payments more than five days late. Tenants shall pay in addition to rent, an additional late charge of $10.00 when payments are more than fifteen days late. Tenant shall pay in addition to rent $15.00 as liquidated damages for said dishonored bank check.

Tenant agrees and covenants with Owner that he will not use said premises for any unlawful purpose and he will pay the rent as it becomes due, and that upon expiration of his use, Tenant will return said premises in good condition and clean to Owner, and that Tenant will not store any explosive or highly flammable material nor perishable goods on said premises.

Tenant acknowledges that Owner shall not be liable to Tenant for any loss or damage that may be occasioned to Tenant’s property resulting from fire, water, rainstorms, tornadoes, explosions, insects, or any cause whatsoever, and that Tenant shall at his own expense insure such personal property. Tenant further agrees to indemnify Owner and to hold Owner harmless from any loss, damage, expense or claim arising out of Tenant’s acts or omissions. All property stored within Owner’s premises shall be at the Tenant’s sole risk.

This storage agreement shall automatically be extended on the first day of each month following the expiration of Tenant’s original term unless Tenant, in writing, delivers to Owner written notice of intent to terminate this agreement at least ten (10) days prior to the end of the then current rental month. Owner reserves the right to terminate this agreement at the end of any rental period by giving Tenant (10) ten days notice tot he address set forth herein and to terminate such lease immediately in the event of breach of any of the terms or conditions of this agreement, including nonpayment of rent provided herein.

In the event Tenant fails to pay the rental obligation provided herein, Owner may overlock Tenant’s storage area and notify Tenant thereof. Owner is hereby given a lien upon Tenant’s property now, or any time hereafter, stored on said premises as security for the renal payments due to and for the breach of any obligations of Tenant as provided herein. In the event that Tenant shall remain on the premises after the last day of the term of this lease, or in the event that Tenant is notified of any breach of the obligations herein and fails to correct them, Tenant grants Owner the authority and right to reenter, seize and take possession of the property located in said units for the rent arrearage or the breach of the covenants herein. Owner shall notify Tenant of such reentry and seizure by notice to the Tenant at the address set forth herein, and in the event that Tenant has not cured such defect within ten (10) days of the date of the notice. Owner may sell the property seized at public or private sale for the payments due plus any expenses of sale.

The interest created by this agreement is that of a lease between the Owner and Tenant and may not be sublet or assigned. Tenant acknowledges that Owner will not be furnishing any heat tot he premises.

Tenant acknowledges that he has inspected the premises and finds the same in satisfactory condition for Tenant’s intended use.

Tenant hereby grants to Owner or Owner’s agent at reasonable times the right to enter and inspect the premises and to make repairs and to show prospective tenants the premises during the 30 days period prior to termination.

Tenant agrees to abide by all rules and policies that are now in effect or may be hereafter put into effect by Owner from time to time. Written rules are explained and are posted on the site and in the office.

Owner reserves the right to relocate Tenant to any location of comparable size.
