ESTOPPEL CERTIFICATE

NOTES

The following notice of non-responsibility is a generic version of a format previously used by a property manager in Arizona.  We want to mention several things. 

Although there may more complex and possibly more legally correct versions of this document available, we feel that it is worthwhile to have the this very basic one available on our site.  First, it may be useable with minor editing in many circumstances and is certainly better than nothing.  Second, if nothing else, it provides an introduction to the format of an estoppel certificate for those who have never seen one.

We have modified the document so that it can be customized for your particular property.  All items in RED will require editing.  For some of the items requiring editing, we have included information in parenthesis to guide you.  After you have completed the editing, you may have to change the color to black, depending upon how you perform the editing.  If you insert your cursor ahead of the red item, type in your information, and delete the red items, no color editing should be necessary.

You may, of course, wish to modify the document beyond the red items, including adding other clauses.  You may also take clauses from this document to other documents that you have.  We advise you to seek legal counsel or investigate the law yourself.

Note that Microsoft Word’s spelling and grammar checkers may indicate spelling and/or grammar errors in the document.  Although it is possible that there are real errors in the document, it is more likely that the indication results from (1) legal or other specialized terms not in Word’s dictionary, (2) acronyms not in Word’s dictionary, (3) word combinations often used in leases that might not meet Word’s grammar rules, (4) the generic words used where editing is required, and (5) the inclusion of the parenthetical hints associated with certain terms requiring editing.  You are, of course, free to modify grammar, but be careful that the meaning is not materially changed. 

We have included provision for a revision date at the top of the first page so that you can keep track of versions if you make modifications to the document other than the red items.

This form is provided as a service to RHOL members without warranty of legality in any particular jurisdiction.  Accordingly, of the form should be should be used only following determination that the clause(s) meet the laws of federal, state, and local governments.

Finally, you will note that we have tried a different approach in formatting this Form than we have taken with other forms currently available on our site.  We would appreciate any feedback that you would care to provide regarding the format used – specifically, the RED font for items requiring customization for specific properties.  We would like to know whether this format is helpful or confusing.  Please send comments to Ralph@cses.com regarding whether or not it is worth the substantial extra effort to provide forms formatted in this way or whether in fact it adds confusion.
